It seems to me bankruptcy sales should go to the highest bidder. No backroom deals should be allowed to include "other" items that are up to the discretion of the judge and not extended to all parties. Furthermore, the "added" bid items, like court costs, are not even REAL as the lawyers can waive those costs post sale and so it because very shady indeed.

The families, due to the amount owed them, are due something like 97 cents of every dollar of proceeds. The bid they worked out with the onion was an offer saying "no matter what, the other creditors get $100k more if this bid wins". The trustees looked at the deal and said "ok... The families have said they would prefer the assets not go to his allies so they're better off with this bid. The other creditors get $100k more so they're better off. This bid wins because all parties are better off." The way the numbers work out, a cash bid would have needed to be significantly larger before the money in the onion bid would fail to keep up. A dollar on the onion side needs to be matched by 33 on the other side.
