Most people say to punish them... Then they come out of sleep and are sent to a jail with the memory of their actions erased.

ОтветитьI was just wondering why Japan doesn't give suspects the right to remain silent and right to counsel during questioning. That's a big reason on why the conviction rate is so high! We Americans got those rights, and our conviction rates got lower because of it.

In this instance, I must respectfully disagree, a 99% conviction rate is insanely high even if most cases are dropped prior to going to trial.

ОтветитьIt's not really misleading. I doubt anyone was under the impression that even the smallest transgression resulted in a jail sentence in Japan. This 99+% conviction rate suggests that police and prosecutors decide the fate of the defendant without the chance for a defense. You need attorneys to defend your rights and challenge the government.

ОтветитьIts the same in my country. I'm an attorney. Its not really justice - we have serious crimes but if there's no evidence then the prosecutor declines to prosecute.
ОтветитьI live in the US and I believe our justice system has serious flaws (overworked public defenders, vast majority of cases end in plea bargain, the bail system) but Japan still sounds worse.

I think the people misunderstood due to their own lack of knowledge about legal proceedings. I actually watch the Economist video before i came here, i had no such misunderstanding. But i suppose Economist could have done a better job explaining to people that lacks even the most basic understanding of modern criminal justice system.
lol American think japan's justice system is worse than US. In US rich people are easily getting away with any crimes.
