As has been mentioned, the same thing happened IRL. In 2017 a pickup truck and a semi were involved in a head-on collision. The driver of the pickup was DOA at the scene but the driver of the semi was alive, albeit severely injured and comatose. The hospital policy for blood draws required either: 1. the Patient be under arrest when they were brought in; 2. the Police have a warrant for the blood; or 3. the Patient provides consent. None of the three were true so the nurse refused to draw blood for the Police. Officers demanded it repeatedly, despite repeated refusals and being informed by hospital administrators that they would not get the blood. The nurse was arrested for obstruction of justice. She was released without charges and sued the city, settling for 500,000 dollars. In addition, the arresting officer was fired and the watch commander in charge during that shift was demoted two ranks. In addition, the department changed their policies to require a warrant or consent before blood draws could be performed. The incident also resulted in Utah passing a law that mandated either informed consent or a warrant before police could take blood draws.

Everyone in the nurses side because shes the underdog but the "victim" hit a house with a family inside while under the influence. I get doctors cant just delay care but are we really hating on the police cuz they were trying to put a criminal, a criminal who had just hurt a group if innocents due to VERY poor decision making, in jail? I really think people need to remember nuance when they watch clips like this.

With the patient going into surgery , wouldn't they test his blood to check and see if he had anything in his system that would react to anesthesia ?

Virtually all patients that walk in the door of an emergency department have their blood drawn, especially traumas. If law enforcement wanted to test the patients BAC, all they needed to do was send a letter of preservation of biological specimens, which takes minutes to do.

Also, in the state of Illinois, you consent to have your blood tested for alcohol if it’s during the investigation of a motor vehicle accident when you sign your license.

Witnessed this first hand, twice one where the victims family watches the DUI guy go with nothing. The second the hospital fought even with a search warrant present. Policy don't trump law. It's always about the person on the gurney not the person they hurt. That is the new fight where I live, are the EMTs and doctors contaminating blood when all they have to do is draw blood a few seconds before the IV or pain killers, hold the blood until a search warrant is available or needed?

If IV fluids would affect the accuracy of the blood draw it was already too late as soon as the IV was in. Why did that officer wait until they were moving him to an OR to realize she needed that blood draw “right effing now!”?

And the real life incident didn’t end like that. The cop was fired and the nurse paid big time. Cops cannot arrest any medical professional for refusing to break HIPAA law.
