Hi i have worked 4 years (till 2020) for a medicine company named lupin limited. On march 2020 i came home for leave but cant go back to my work location due to lockdown imposed and border sealing of the state (sikkim) where I work. Also company stopped paying me any salary since march. So i decided to stop wasting my time and mailed them my resignation but they refused to give any response and threatened me to mark as absconding as I have not dome any notice period. Please help.

ОтветитьAssume that my manager has approved my last working day with only 7 days of notice and my actual notice period is 60 days. Later my company says you need to serve 60 days. Has the company the right to do so?

I have resigned in my company where I worked for 5 years as I got new opportunity in another company. My new company wants me to join in 45 days but my current company has notice period of 3 months. In my offer letter of current company where I am serving Notice period, the following clause is mentioned :
1. During probation or training period, your services will be liable for termination with a notice of fifteen days from either side without having to assign a reason. 15 days remuneration shall be payable by the party terminating the employment.
2. On confirmation, your services will be liable for termination on a one month notice or remuneration in lieu thereof, payable as per the company's rule.
This offer letter was given to me in 2015 but in 2017 I(and everyone in company) was given a written notice that Notice period is revised to 3 months.
So, am I eligible to pay the salary of the remaining days in case I do not wish to serve complete notice period? Can my current employer spoil my relieving letter or background verification in exchange as HR has verbally threatened me on call of which I have recording. I have completed 20 days on Notice period but if I serve complete 90 days, my next opportunity might be cancelled as next employer needs early joining.
Please advise.

ОтветитьFor the past 1 year I'm working from home for my company and I had an argument with HR after that I send my resignation and asked what to do for my letter (experience latter) but they never responded and I was waiting for management response so I send 2nd letter for update and they did regarding my resignation but they accused me of Absconding in reality, they never send me any message or call or any official warning letter rather they change my office email id password, not responding to my mail and now telling me after explaining all things between me and HR as well why I took this decision in writing to the boss but Boss send mail "Mr. You send resign not notice you should be grateful I didn't ask for notice period compensation". but I never told them on any written document not even in my resignation I'm not going to serve so why are they making assumptions and making decisions without my consent what to do?

Sir i am Junior engineer trainee at Schneider electric ahmednagar plant . During this second wave of corona my family condition is not good i lost my grandfather and also my dad were serious in hospital also my mother and I were positive due to this i didn't go to my job at Ahmednagar as i taken leave and came to mumbai .
Due to this i didn't go to job for 2 months and after seeing condition of my family i decided to resign from my job and i reported at my job and given resignation but the HR is saying to pay for 2 months and additional notice period salary which is 3 months salary is around 60k otherwise they will
be absconding me and told me they can file police complaint for not paying but and i also don't sign any contract for that .
I also reported to my job and given a proper resignation to my reporting manager but HR is telling me pay 60k .

ОтветитьWhat if an employee served partial notice and offered the company to pay in lieu of remaining notice period and the same thing is also mentioned in the agreement that "if any person failed to serve full notice then he has to pay for the damages caused to company", then in that case, can a company hold his relieving or experience letter? Or will he get abscond letter?

ОтветитьSir I have one question, I have resigned my position in my current company where there is 3 months notice period, it's just impossible to serve this notice period because my new recruiter cannot wait for 3 months. It's question of my career and life. But there nothing mentioned in offer letter regarding buy out or buy back option, even not mentioned any calculation. Inspite of this I agreed for paying 45 days whatever the amount and 45 days I serve my notice. I agreed to this because my HR told this. Now our GM is telling they won't leave me because it's mandatory to serve 3 months. And they creating huge pressure on me and planning to somehow spoil my opportunity n life.

I am working with company name Square Yards it is real estate broker firm and this company claim that are there in 12 country of world I join in this company with salary 18000 in appointment letter and only paying me 12000 saying you have not done any selling of flats in last month .even I have done business of selling flats they don't give my salary of counted business by saying you were inactive last month now more then 1 lacs incentive is not givin by them and salary giving 12000 they run branch pan India situation is same pan India this is companies are one of the scam of the real estate please take legal action against help the employees like me square yards

ОтветитьI am a software developer working remotely for an organisation based out in Bangalore. I am currently serving my notice period of two months. I have already initiated my resignation email on 19th April but haven't received any acknowledgement or acceptance from concerned person thou i have even sent three reminders too. I have joined this organisation four months back.
I have shared this scenario to my future organisation as well and they are ready to consider my joining without any documentation from my previous employer.

ОтветитьI resigned my job but haven’t go to office because of health reasons (accident) which happened 1 month before accident. I need to be bed rest for 1 year. So I applied resignation. At the time of resignation company said to serve 90 days. After completing the 90 days of notice period I asked for clearance certificate but company refused to provide as I haven’t serve notice period by Attending work. Whether notice period means to attend work or 90 days written notice is sufficient
ОтветитьSir, In my appointment letter a condition is mentioned such as " Your service may be terminated with one month's notice or one month's salary in lieu thereof from either side for which neither side shall be required to assign any reason". On the basis of this point can I resign with immediate effect with refund of one month's salary? And what is the meaning of 'Salary' here? Only "Basic" or "Basic+ All others" or Gross Salary?Please share your valuable opinion with reference of any Section or Act which I can mentioned at the time of my resignation if required.
