If the races were reversed in this case not one of us would have ever even known it happened and no charges would have been filed. That's what makes this situation so idiotic.

This is beyond the social norms of reality in the city, NYC is an open air drug market. Like other places, these people often die because of their own drug use so to have a trained Marine (no offense but Marines are often victims of PTSD) hold this junkie in a chokehold for several minutes it sets a bad precedent. This is not rocket science, drug dealers sell drugs, users sometimes have bad drug experiences, Daniel Penny seems to be the goon or hired gun that just so happened to cause Jordan's demise. Hero? The subway car had cleared of all passengers & still Penny choked this desperate man till he died. 2 additional men were also on hand to support Penny. Was Penny afraid that this man would escape the train car if he loosened the chokehold? With 2 other men helping? Was Penny afraid & paralyzed with fear for himself at this point? Penny just simply lacked any fair code of hand to hand combat skills to avoid killing this sick man. Penny also lacks any hand to hand combat disengagement or deescalating plan for this sick man or any man it would seem. A trained MMA fighter with any reasonable code of ethical experience in battle would have assessed this sick man's fighting abilities during the struggle & moved to less lethal position without loss of control. No sustained neck lock needed!! Period! Leg hooks in & arms restrained would have worked well! Roll around if necessary but no sustained neck lock! Penny is ignorant. He was simply the wrong man to take control of this situation & this sick man tragically paid with his life. He deserves a civil suit for his willful ignorance.

Daniel Penny held Neely in a chokehold only enough to subdue him since he was a crazed drug addict threatening everyone on the subway. He was breathing when he was at the hospital for several hours--he caused his own demise. These charges against Daniel are abominable and a political travesty.
