Chief Clerk of Court in Montgomery County, John McManus swore an oath to uphold the United States Construction and yet breaks the law and his oath daily. Federal law comes from Congress and CANNOT be changed by State Of Ohio ordinance or statute. Filing fees have been defined as an excise tax, caselaw: That filing fees are considered an excise tax intended to impose taxes for a license to conduct business, recognized by Congress as intent to tax such businesses for National purposes, license tax cases. 72 US (5 Wall.) 462 (1866)


Furthermore, it is a violation of the United States Constitution you are trying to turn a protected right into a privilege through taxation without representation. Loughsborough Vs. Blake 18 US 317 1820



The individual unlike the corporation, cannot be taxed for the mere privilege of existing. The corporation is an artificial entity which owes its existence and charter powers to the state. But the individuals' rights to live and own property are natural rights for the enjoyment of. Which an excise tax cannot be imposed. These rulings have never changed, yet when I start asking about this in all Clerk of Courts Office , the personnel at the counter lose their minds and actually get mad, rude, and indignant, repeatedly telling me that I want to file anything , I’m going to have to pay the fees. The ONLY clerk of court in Montgomery County smart enough not to do this is the Juvenile Justice Division, mainly because I had been presenting the relative laws and the United States Code every step of the way . . The personnel at every other agency can’t even answer whether filings in their office is a right or a privilege. And don’t know the difference. So, all of this action falls under the oaths of office for the Elected officials over the respective departments.

I have my declaration of status (exact example attached), recorded onto the face of the OFFICIAL RECORD , and my question to both offices receiving this email is , how do I personally stop this unlawful conduct from prohibiting me from exercising my Constitutional Rights and creating a roadblock at each and every interaction with ALL of these entities. Most issues that require filings with the clerk have different time barre stipulation and it causes surrendering to this unlawful excise tax to prevent failure of timely filed documents, etcetera.
